These Terms & Conditions apply to all devices, equipment and accessories presented to Cheap Geek for diagnostics, repair, upgrade, data recovery, software services or any other workshop-based services.


1. REPAIR AUTHORISATION

By presenting a device to Cheap Geek for diagnosis, repair, upgrade, inspection or service, the Customer authorises Cheap Geek to:

  • Inspect the device;
  • Disassemble the device where required;
  • Perform diagnostic testing;
  • Install replacement parts;
  • Install software;
  • Update firmware;
  • Configure hardware and software;
  • Conduct testing before and after repair.

The Customer confirms they are the legal owner of the device or have authority from the legal owner to authorise repairs.


1A. CUSTOMER AUTHORITY

The Customer warrants that they are the legal owner of the device or have full authority from the legal owner to authorise diagnostics, repairs, upgrades, software installation, data access, testing and any other services performed by Cheap Geek.

Cheap Geek shall not be liable for any dispute regarding ownership, authority, permission or entitlement to authorise work on any device, account, software, storage media or data.


2. CUSTOMER DATA

The Customer acknowledges that repairs may result in:

  • Data loss;
  • Data corruption;
  • Software reinstallation;
  • Factory resets;
  • Loss of settings;
  • Loss of applications;
  • Loss of account access.

Cheap Geek strongly recommends that all data be backed up prior to repair.

Unless specifically engaged to perform backup services, the Customer remains solely responsible for all data.


2A. CUSTOMER BACKUPS

The Customer acknowledges that they are solely responsible for maintaining backups of all data stored on the device.

Cheap Geek shall not be responsible for:

  • Data loss;
  • Data corruption;
  • Missing files;
  • Failed backups;
  • Failed restorations;
  • Loss of software licences;
  • Loss of encryption keys;
  • Cloud synchronisation failures.

The Customer accepts all risks associated with proceeding without a current backup.


3. DEVICE PASSWORDS & ACCESS

The Customer may be required to provide:

  • Passcodes;
  • Passwords;
  • PIN numbers;
  • Administrator credentials;
  • Biometric access.

Where credentials are not provided, Cheap Geek may be unable to fully test or complete repairs.

No refund shall be payable where repairs cannot be completed due to access restrictions.


3A. RIGHT TO REFUSE SERVICE

Cheap Geek reserves the right to refuse, suspend or discontinue repairs where:

  • Technician safety may be compromised;
  • Illegal activity is suspected;
  • Required passwords are not provided;
  • The device presents a safety risk;
  • The Customer behaves aggressively, abusively or inappropriately;
  • The requested repair falls outside Cheap Geek’s capabilities.

Charges incurred prior to refusal remain payable.


3B. ILLEGAL OR STOLEN DEVICES

Cheap Geek reserves the right to refuse service where ownership of a device cannot be reasonably verified.

Where Cheap Geek reasonably suspects a device may be stolen, unlawfully obtained or connected to criminal activity, Cheap Geek may retain records and cooperate with law enforcement agencies as permitted by law.

No compensation shall be payable where services are refused under this clause.


4. DIAGNOSTIC FEES

Diagnostic fees apply for inspection, testing and fault identification.

Diagnostic fees are payable regardless of whether:

  • The repair proceeds;
  • The repair is declined;
  • The repair is successful;
    • No fault is identified.

Diagnostic fees are non-refundable once diagnostic work has commenced.


5. QUOTATIONS

All quotations are estimates based on information available at the time of inspection.

Additional faults may be discovered during:

  • Diagnostics;
  • Testing;
  • Disassembly;
  • Repair.

Cheap Geek reserves the right to revise quotations where additional faults are identified.

Approval will be sought before additional chargeable work is undertaken where reasonably practicable.


5A. PRE-EXISTING DAMAGE

The Customer acknowledges that devices may contain pre-existing faults, damage or defects that are not immediately apparent.

Cheap Geek shall not be liable for faults discovered during diagnostics, testing, disassembly or repair where such faults existed prior to service.

The discovery of pre-existing damage does not constitute damage caused by Cheap Geek.


5B. DEVICE CONDITION REPORTS

Cheap Geek may document the condition of devices upon receipt.

This may include:

• Photographs;
• Videos;
• Written notes;
• Functional testing records.

Such records may be used as evidence in warranty claims, disputes or legal proceedings.


6. PARTS

Repairs may utilise:

  • New parts;
  • Refurbished parts;
  • OEM parts;
  • Compatible aftermarket parts;
  • Reconditioned parts.

Part selection will be determined by:

  • Availability;
  • Device age;
  • Repair requirements;
  • Customer instructions.

Unless specifically stated in writing, replacement parts supplied by Cheap Geek are not guaranteed to be manufacturer-original components.

The Customer authorises the installation of suitable replacement components.


6A. DISASSEMBLY RISK

The Customer acknowledges that certain repairs require disassembly of devices that may already be weakened by:

• Age;
• Wear and tear;
• Previous repairs;
• Impact damage;
• Liquid damage;
• Manufacturing defects.

Despite exercising reasonable care, disassembly may reveal or aggravate pre-existing defects.

Cheap Geek shall not be liable for failures caused by pre-existing conditions discovered during disassembly.


6B. FRAGILE COMPONENTS

Certain components may be fragile due to age, prior repairs or damage.

These may include:

• Screens;
• Digitisers;
• Flex cables;
• Connectors;
• Adhesives;
• Plastics;
• Glass panels.

Cheap Geek shall not be liable where such components fail due to pre-existing weakness during repair.


7. SCREEN REPAIRS

The Customer acknowledges:

  • Hidden frame damage may exist;
  • OLED or LCD defects may become apparent after repair;
  • Touchscreen faults may be unrelated to the replacement screen;
  • Previously repaired devices may contain non-genuine components.

Cheap Geek is not responsible for pre-existing defects discovered during repair.


8. BATTERY REPAIRS

Battery replacements improve battery performance but do not guarantee original manufacturer battery life.

Cheap Geek is not responsible for:

  • Existing charging faults;
  • Motherboard charging issues;
  • Charging IC failures;
  • Third-party charging accessories;
  • Battery calibration limitations.

9. FACE ID, TOUCH ID & BIOMETRIC SYSTEMS

Certain manufacturers pair biometric systems to original components.

Cheap Geek cannot guarantee:

  • Face ID functionality;
  • Touch ID functionality;
  • Fingerprint readers;
  • Biometric authentication systems

where previous damage, prior repairs or manufacturer restrictions exist.


9A. DEVICE LOCKS

Cheap Geek is not responsible for:

• Activation locks;
• iCloud locks;
• Google locks;
• Manufacturer security locks;
• Forgotten passwords.

The Customer remains solely responsible for account ownership and account recovery.


10. WATER DAMAGED DEVICES

Liquid damage repairs are performed on a best-efforts basis.

The Customer acknowledges:

  • Corrosion may continue after repair;
  • Additional faults may develop after repair;
  • Devices may fail completely without warning;
  • Successful repair today does not guarantee future reliability.

No warranty is provided against future corrosion resulting from prior liquid damage.


10A. TECHNOLOGY LIMITATIONS

The Customer acknowledges that:

  • Not all faults can be identified;
  • Not all faults can be repaired;
  • Additional faults may exist;
  • Successful repair of one fault does not guarantee repair of all faults.

Diagnostic fees remain payable regardless of repair outcome.


10B. NO GUARANTEE OF WATER DAMAGE RECOVERY

Liquid damaged devices may fail completely during testing, diagnosis or repair.

The Customer acknowledges that attempting repair may result in total device failure.

No refund shall be payable solely because a liquid damaged device cannot be recovered.


11. MOTHERBOARD & MICROSOLDERING REPAIRS

Motherboard and microsoldering repairs are highly specialised procedures.

Cheap Geek does not guarantee:

  • Successful repair;
  • Long-term reliability;
  • Recovery of all functions.

Such repairs are performed on a best-efforts basis.


12. DATA RECOVERY

Data recovery services are performed on a best-efforts basis.

Cheap Geek makes no guarantee that:

  • Any data will be recovered;
  • All data will be recovered;
  • Recovered data will be usable.

Data recovery charges remain payable regardless of outcome unless otherwise agreed.


12A. STORAGE MEDIA FAILURE

Storage devices may fail unexpectedly during diagnostics or data recovery attempts.

Cheap Geek shall not be liable for loss of data resulting from pre-existing storage device deterioration or failure.


13. DEPOSITS & SPECIAL ORDER PARTS

Special order parts may require:

  • Full payment in advance; or
  • A non-refundable deposit.

Deposits may not be refundable once parts have been ordered from suppliers.


13A. SPECIAL ORDER PARTS RETURNS

Special order parts obtained specifically for a Customer may not be returnable.

Where a repair is cancelled after parts have been ordered, Cheap Geek may retain deposits to recover supplier costs.


14. COLLECTION OF DEVICES

Customers must collect devices promptly after notification that repairs are complete.

Storage fees may apply after thirty (30) days.


14A. ACCESSORIES

Customers are responsible for collecting all accessories supplied with devices including:

• Chargers;
• Cases;
• SIM cards;
• Memory cards;
• Styluses;
• Dongles;
• Adapters.

Cheap Geek is not responsible for accessories not recorded at check-in.


15. UNCOLLECTED DEVICES

Devices remaining uncollected for more than ninety (90) days may be dealt with in accordance with applicable abandoned goods legislation after reasonable attempts to contact the Customer.

Any proceeds may be applied towards outstanding charges.


15A. ABANDONED GOODS

Where permitted by law, Cheap Geek may:

  • Sell the device;
  • Recycle the device;
  • Dispose of the device;

following reasonable attempts to contact the Customer.


15B. STORAGE FEES

Devices remaining uncollected for more than thirty (30) days may incur storage fees of $5.00 per day per item or such other amount as notified by Cheap Geek.


16. WARRANTY

All warranty claims are governed by the current Cheap Geek Repair & Accessory Warranty Policy.

Warranty assessment is required before any warranty claim can be approved.


17. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Cheap Geek’s liability shall be limited to:

  • Re-performing services;
  • Repairing defects;
  • Replacing defective parts;
  • Refunding the amount paid for the repair.

17A. CONSEQUENTIAL LOSS

To the maximum extent permitted by law, Cheap Geek shall not be liable for:

  • Loss of profits;
  • Loss of business;
  • Loss of income;
  • Loss of opportunity;
  • Loss of goodwill;
  • Business interruption;
  • Data loss;
  • Indirect loss;
  • Consequential loss.

This applies even where the device contains business-critical information.


17B. MALWARE & SECURITY

The Customer acknowledges that:

  • Malware may remain undetected;
  • Future malware infections may occur;
  • Security threats continually evolve.

Cheap Geek does not guarantee that devices will remain secure following repair or service.


17C. CCTV MONITORING

For security, theft prevention, staff safety and quality assurance purposes, Cheap Geek premises may be monitored by CCTV systems.

Customers entering the premises consent to such monitoring where permitted by law.


17D. PHOTOGRAPHIC RECORDS

Cheap Geek may take photographs or videos of devices before, during and after repair.

These records may be used for:

  • Diagnostics;
  • Warranty claims;
  • Quality assurance;
  • Insurance claims;
  • Dispute resolution.

Such records remain the property of Cheap Geek.


17E. PAYMENT DISPUTES & CHARGEBACKS

Where services have been properly performed or goods properly supplied, the Customer agrees not to initiate an unjustified chargeback or payment reversal.

Where a chargeback is initiated, Cheap Geek reserves the right to recover:

  • Outstanding repair fees;
  • Merchant fees;
  • Chargeback fees;
  • Administrative costs;
  • Debt recovery costs;
  • Legal expenses.

17F. EMOTIONAL DISTRESS CLAIMS

To the maximum extent permitted by law, Cheap Geek shall not be liable for emotional distress, inconvenience or disappointment arising from device failure, data loss or repair outcomes.


17G. BUSINESS INTERRUPTION

Cheap Geek shall not be liable for losses arising from:

• Missed appointments;
• Lost business opportunities;
• Downtime;
• Inability to trade;
• Employee downtime;
• Delayed projects.

Customers remain responsible for maintaining contingency arrangements.


18. AUSTRALIAN CONSUMER LAW

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.

Customers are entitled to consumer guarantees that cannot be excluded by law.


19. GOVERNING LAW

These Terms & Conditions are governed by the laws of Queensland, Australia.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Courts of Queensland.
