1. Introduction
Welcome to CHEAP GEEK.
By accessing or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree with any part of these terms, you must not use our services. Our services include, but are not limited to, mobile computer repair and related technical support.

These terms and conditions, together with our Privacy Policy, form the entire agreement between you (the “Customer”) and PREMIUM TECHNOLOGY GROUP PTY LTD ATF PREMIUM TECHNOLOGY TRUST TA CHEAP GEEK (“Cheap Geek”).

2. Definitions
Client: Any individual or entity requesting services from Premium Technology Group Pty Ltd ATF Premium Technology Trust TA Cheap Geek (hereafter referred to as “Cheap Geek”). This includes all persons or organizations that have entered into an agreement for the provision of services.

Technician: An employee or subcontractor assigned by Cheap Geek to provide services to the Client. This person is responsible for delivering the technical support, repairs, or maintenance services as per the service agreement.

Services: Any technical support, repair, or maintenance performed by Cheap Geek. Services include, but are not limited to, hardware repair, software installation, data recovery, and system optimisation.

3. Acceptance of Terms
By booking and using the services of Cheap Geek, the Customer agrees to the following terms and conditions. These terms and conditions, together with the Privacy Policy, form the entire agreement between the Customer and Cheap Geek. If the Customer does not agree with any part of these terms and conditions, they must not use our services.

4. Services
Cheap Geek provides mobile computer repair services which include, but are not limited to:
Computer setup and troubleshooting:
Diagnosis and repair of software and hardware issues.

Virus, spyware, and malware removal: Identification and removal of malicious software.

Data backup and recovery:
Secure backup solutions and recovery of lost data.

Software installation and setup:
Operating systems and applications.

Hardware repairs and upgrades:
Repair and replacement of computer components.

Network setup and security:
Configuration and security of home and business networks.

5. Bookings and Appointments
Booking Process: Services are available by appointment only, which can be scheduled online, and over the phone. The Customer must provide accurate contact details and a brief description of the issue.

Service Availability: Appointments are subject to technician availability. Same-day service is offered but not guaranteed.

Service Locations: Technicians will travel to the Customer’s location within the service area. If the location is outside the standard service area, additional travel fees may apply.

6. Fees and Payment
Service Fees: The Client agrees to pay all fees and charges for the services provided by Cheap Geek. These fees will be detailed in the invoice provided at the conclusion of the service. The rates for services will be communicated to the Client beforehand and will be based on the nature and extent of the service required.

Please note that our standard fees and conditions include:

a. $159.00 per hour on site service fee applies and is inclusive of GST. This includes one-hour of technician service and support.

b. a one-hour minimum appointment applies.

c. further charging is at a rate of $2.65 inclusive of GST per 1 minute.

d. most issues can be solved in the first hour. If the technician, however, expects that it will take longer, he or she will usually know within the first 15 minutes. The technician will give you options, and you can decide how you want to proceed.

e. An additional $49 surcharge applies for on-site support on Saturdays, Sundays and Public Holidays, and will be added to the on-site service fee.

Payment Terms: Payments are due upon receipt of the invoice unless otherwise agreed in writing. Late payments may incur additional charges, which will be detailed in the service agreement. Cheap Geek reserves the right to suspend services or charge interest on overdue amounts as per the prevailing rates. In cases

of non-payment, Cheap Geek reserves the right to retain possession of any devices or components until full payment is received. Additional charges may apply for late payments or debt recovery.

Methods of Payment: Accepted payment methods include cash, credit card, direct bank transfer, and any other methods as agreed upon at the time of service. Cheap Geek will provide necessary details for each payment method to ensure a smooth transaction process.

Disputed Charges: Any disputed charges must be reported to Cheap Geek within 14 days of the invoice date. The Client agrees to pay the undisputed portion of the invoice while the dispute is under investigation. Both parties will work in good faith to resolve any disputes promptly.

7. Cancellations and Rescheduling
Notice Period: Customers may cancel or reschedule an appointment with at least 24 hours’ notice without incurring a fee. Cancellations or rescheduling within 24 hours of the appointment may incur at the managers discretion.

8. Repair Notice
Where our services involve repairing your goods, please be aware that:

a. Goods brought in for repair may be replaced with refurbished goods of the same type instead of being repaired. Refurbished parts may also be used in the repair process, and

b. Repairing your goods may lead to the loss of any user-generated data. Please ensure you have made a backup copy of any data stored on your goods.

9. Acknowledgment of Risk
The client acknowledges that due to the nature of the services being performed, there is a potential risk of damage or loss. This includes, but is not limited to, damage to the client’s office, home, business computer hardware, cabling, hubs, routers, switches, peripherals, accessories, and furniture, as well as the potential risk of damage, corruption, or loss of computer software, applications, data, and data storage media.

10. Access to property
The client grants Cheap Geek, its agents, and service representatives, permission to physically access the client’s home or office property where the client’s computer system and/or network reside.

11. Access and Manipulation of Data
The client grants Cheap Geek, its agents, and service representatives, access, security rights, and permission to open, view, modify, edit, delete, or otherwise manipulate the client’s computer software, applications, data, and data storage media. This includes, but is not limited to, the computer Operating System, word processing, spreadsheets, databases, workflow, graphics, audio, video, system drivers and libraries, and any other type of software or data that may be contained on the client’s computer system or network

12. Disassembly of Computer Systems
The client grants Cheap Geek, its agents, and service representatives, access and permission to physically disassemble
any and all computer systems, components, networks, cabling, hubs, routers, switches, peripherals, and accessories necessary to perform said services.

13. Installation of Hardware
The client grants Cheap Geek, its agents, and service representatives, permission to install hardware on the client’s computer and/or network. This includes, but is not limited to, processor chips, memory chips, cooling fans, batteries, hard drives, tape drives, storage devices, modem and communication devices, audio and video cards, network interface cards, hubs, routers, switches, printers, scanners, cables, and any other hardware requested to be installed by the client.

14. Installation of Software
The client grants Cheap Geek, its agents, and service representatives, permission to download and/or install software on the client’s computer and/or network. This includes, but is not limited to, virus scanners, diagnosis and repair utilities, drivers, libraries, and software requested to be installed by the client. Cheap Geek does not check for licensing compliance for any software provided by the client to be installed on their computer systems. It is the responsibility of the client to have proper licensing for any software provided. Cheap Geek reserves the right to refuse to install any software for which proper licensing cannot be demonstrated.

15. Release of Liability
Limited Liability: Cheap Geek will use all reasonable efforts to ensure the integrity and safety of the Client’s data and equipment. However, Cheap Geek shall not be liable for any loss or damage to data, software, or hardware during the provision of services. Clients are encouraged to back up their data prior to service.

No Warranty: Except as expressly provided in writing, Cheap Geek makes no warranties or representations regarding the services, including but not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. This clause ensures that Cheap Geek is not held responsible for outcomes beyond their control.

Indemnification: The Client agrees to indemnify and hold harmless Cheap Geek, its employees, and subcontractors against any and all claims, damages, and expenses arising out of or related to the services provided. This includes any third-party claims due to the Client’s use of the services.

Force Majeure: Cheap Geek will not be liable for any failure or delay in performing services if such failure or delay is due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, and natural disasters. This clause provides protection in case of unforeseen events that prevent service delivery.

16. Privacy Policy
Collection of Personal Information: Cheap Geek will collect personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Information collected includes contact details, payment information, and any other relevant data necessary for the provision of services.

Use of Personal Information: Personal information collected will be used solely for the purpose of providing services, processing payments, and communicating with the Client. Cheap Geek will not share personal information with third parties without the Client’s consent, except as required by law.

Data Security: Cheap Geek will take all reasonable steps to protect personal information from misuse, loss, unauthorized access, modification, or disclosure. This includes implementing appropriate technical and organizational measures.

17. Additional Provisions
Confidentiality: Both parties agree to keep confidential any proprietary information disclosed during the provision of services, except as required by law. This includes any business secrets, customer information, and personal data shared during the service process.

Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the State of Queensland Australia. Any disputes arising under these terms will be subject to the jurisdiction of the courts in Queensland.

Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. This ensures that the overall agreement remains effective even if one part is invalidated.

Amendments: Cheap Geek reserves the right to amend these terms and conditions at any time. Clients will be notified of any changes prior to the provision of new services. The amendments will become effective upon notification, and continued use of the services will constitute acceptance of the new terms.

Non-Solicitation Agreement: The client agrees not to actively solicit work from any of Cheap Geek’s contractors or employees for computer-related services without prior approval from Cheap Geek. This agreement shall remain in force for one year, beginning with the date of the client’s last completed service with Cheap Geek. This agreement includes all geographic locations where Cheap Geek’s clients reside.

Hardware Offsite Repairs: If our technicians are required to take hardware offsite for repairs or other purposes, and we are unable to establish contact with you for a continuous period of three (3) months, all hardware and data stored on the hardware shall become the exclusive property of Cheap Geek. We shall make reasonable efforts to maintain communication during this period, including but not limited to email, phone calls, and registered mail notifications. It is your responsibility to ensure that accurate and up-to-date contact information is provided to us. If contact is reestablished within the three-month period, we will make arrangements to return the hardware and any associated data to you. However, any costs incurred during this period, including storage and maintenance, shall be borne by you. By utilizing our services and agreeing to these terms and conditions, you acknowledge and accept this provision.

You acknowledge that, to the extent permitted by law (including the Australian Consumer Law):

Recommendations for upgrades/replacements: In providing services and goods to you, we may identify that upgrading or replacing your software or hardware is necessary to solve your problem. In such cases, you acknowledge that we fulfill our commitment to you by providing a solution, regardless of whether you choose to implement it.

On-site support – return to base for difficult problems: It may not always be possible to resolve all problems via on-site service. In particularly challenging cases, we may, with your permission, need to take your system to our base or third-party premises for diagnosis and repair. We will exercise all due care while in possession of your equipment to ensure no loss or damage occurs.

No guarantee that all issues will be identified: While we make every effort to identify issues with your software and hardware given the nature of technology, we cannot guarantee that all problems or security threats will be identified.

Final solution may differ from initial diagnosis: Computers are complex, and problems may be more deeply rooted or complicated than initially diagnosed. Therefore, our final proposed solution may differ from the initial diagnosis.

Not all issues can be resolved by remote support: You acknowledge that certain problems cannot be resolved over the telephone or by remote system access and may require on-site support.

Timeframes are estimates only: Except for our same-day guarantee, any period or date for delivery of goods or provision of services stated by us is an estimate. We will use our best efforts to meet any estimated dates for delivery of goods or completion of services and will provide you with as much notice as possible of any expected delays.

Failure to follow our instructions or advice: You agree that we are not liable for any loss or damage resulting from your failure to follow our instructions, recommendations, or advice.

18. Customer Responsibilities
Licenses: Customers must ensure that they have proper licenses for all software used. Cheap Geek is not responsible for any issues arising from unlicensed software.

Data Backup Responsibility: Cheap Geek strongly advises the client to safeguard critical data by backing up said data prior to any services performed by Cheap Geek. Unless specifically requested and provided as a paid service by Cheap Geek, the client is responsible for any backup, archiving, or protective storage as well as restoration if required, of the client’s data.

Access: Customers must ensure that our technicians have safe and unobstructed access to the equipment requiring service.

19. Marketing and Promotions
Consent: By using our services, Customers consent to receiving marketing communications from Cheap Geek. Customers may opt-out of these communications at any time.

Promotional Offers: Any promotional offers are subject to specific terms and conditions, which will be provided at the time of the offer.

20. Intellectual Property
Ownership: All intellectual property rights related to the services and any materials provided by Cheap Geek remain the property of Cheap Geek.
Use of Materials: Customers are granted a non-exclusive, non-transferable license to use any materials provided by Cheap Geek for personal use only.

21. Changes to Terms and Conditions
Cheap Geek reserves the right to modify these terms and conditions at any time. Any changes will be communicated to the client and will become effective upon acceptance by the client, either by continued use of services or other forms of acceptance.
