1. INTRODUCTION

These Terms and Conditions govern the provision of services, sale of goods, website use and all dealings between Premium Technology Group Pty Ltd ATF Premium Technology Trust trading as Cheap Geek (“Cheap Geek”, “we”, “our”, “us”) and the Customer (“you”, “your”).

By booking, purchasing, accessing or using any services provided by Cheap Geek, you agree to be bound by these Terms and Conditions.

These Terms and Conditions operate in conjunction with:

  • Our Privacy Policy;
  • Any quotation issued by Cheap Geek;
  • Any invoice issued by Cheap Geek;
  • Any service agreement entered into between Cheap Geek and the Customer;
  • Any applicable Warranty Policy;
  • Any Repair Shop Terms & Conditions.

In the event of inconsistency, the most specific document shall prevail.


2. DEFINITIONS

For the purposes of these Terms and Conditions:

Customer means any individual, company, partnership, trust, association or other entity requesting, purchasing or receiving services from Cheap Geek.

Technician means any employee, contractor, subcontractor or representative engaged by Cheap Geek.

Services means all services supplied by Cheap Geek including but not limited to:

  • Computer repairs
  • Mobile phone repairs
  • Remote support
  • Network support
  • Virus removal
  • Software installation
  • Hardware installation
  • Data recovery
  • Managed services
  • Business support
  • Technology consulting

Goods means all products, components, accessories, software, hardware and equipment supplied by Cheap Geek.

Business Day means Monday to Friday excluding Queensland public holidays.


3. ACCEPTANCE OF TERMS

By requesting services from Cheap Geek you acknowledge that:

(a) You have read these Terms and Conditions.

(b) You understand these Terms and Conditions.

(c) You agree to be legally bound by these Terms and Conditions.

(d) You have authority to enter into these Terms and Conditions.

If you are acting on behalf of a company, partnership, trust or other entity, you warrant that you have authority to bind that entity.


4. CUSTOMER AUTHORITY

The Customer warrants that they are:

(a) The legal owner of the equipment; or

(b) Authorised by the legal owner to approve work being performed.

The Customer further warrants that they have authority to authorise:

  • Repairs
  • Upgrades
  • Software installation
  • Data access
  • Data transfer
  • Data deletion
  • Account access
  • Configuration changes

Cheap Geek shall not be liable for any dispute regarding ownership, authority or permission relating to any equipment or data presented for service.


5. SERVICES PROVIDED

Cheap Geek may provide services including but not limited to:

Computer Services

  • Desktop repairs
  • Laptop repairs
  • Custom PC support
  • Hardware upgrades
  • Software troubleshooting
  • Virus removal
  • Data migration

Business Services

  • Managed IT support
  • Network management
  • Server support
  • Microsoft 365 support
  • Cybersecurity services

Mobile Services

  • Onsite support
  • Remote support
  • Workshop repairs
  • Device collection and delivery

Cheap Geek reserves the right to modify, discontinue or refuse any service offering at any time.


6. BOOKINGS & APPOINTMENTS

Appointments may be booked:

  • Online
  • By telephone
  • By email
  • Through approved booking platforms

Appointment times are estimates only.

Cheap Geek will use reasonable efforts to attend within the allocated appointment window but cannot guarantee attendance times due to:

  • Traffic delays
  • Previous job overruns
  • Weather conditions
  • Emergency service requests
  • Circumstances beyond our control

7. SERVICE AREAS

Cheap Geek provides onsite services throughout designated service areas.

Additional travel fees may apply where:

  • The Customer is located outside standard service areas.
  • Travel exceeds standard coverage zones.
  • Parking costs are incurred.
  • Toll roads are used.

Travel fees will be disclosed before attendance where reasonably practicable.

Cheap Geek reserves the right to refuse attendance outside designated service areas.


8. SAME DAY SERVICES

Cheap Geek may offer same-day service subject to:

  • Technician availability;
  • Location;
  • Traffic conditions;
  • Parts availability.

Same-day service is not guaranteed.

Where a same-day surcharge applies it shall be disclosed at the time of booking.

Failure to provide same-day service does not entitle the Customer to compensation or damages.


9. FEES & CHARGES

Current pricing is published on the Cheap Geek website and may be amended from time to time.

Unless otherwise agreed:

Onsite Services

  • Minimum one-hour charge applies.
  • Time is charged in accordance with current published rates.

Remote Services

  • Minimum charge may apply.
  • Charges continue while a technician is actively working on the issue.

Workshop Services

  • Diagnostic fees may apply.
  • Labour charges apply in addition to parts unless otherwise stated.

Additional Charges

Additional charges may apply for:

  • Parking fees
  • Toll roads
  • Urgent services
  • Weekend services
  • Public holiday services
  • After-hours services
  • Specialist equipment

10. PAYMENT TERMS

Unless otherwise agreed in writing:

(a) Payment is due immediately upon completion of services.

(b) Parts orders may require full or partial prepayment.

(c) Cheap Geek may require deposits before commencing work.

(d) Ownership of goods supplied remains with Cheap Geek until payment has been received in full.

(e) Cheap Geek may suspend services where payment remains outstanding.

(f) Cheap Geek reserves the right to charge:

  • Interest on overdue accounts;
  • Debt recovery costs;
  • Collection agency fees;
  • Legal expenses;
  • Merchant chargeback fees;
  • Administrative costs.

(g) Any invoice disputed by the Customer must be disputed within fourteen (14) days of issue.


11. CANCELLATIONS & RESCHEDULING

11.1 Customers may cancel or reschedule an appointment by providing at least twenty-four (24) hours notice prior to the scheduled appointment time.

11.2 Cheap Geek reserves the right to charge a cancellation fee where:

(a) Less than twenty-four (24) hours notice is provided;

(b) The Customer is unavailable at the agreed appointment time;

(c) Access cannot be obtained to the premises;

(d) The appointment is cancelled after a technician has commenced travel.

11.3 Any cancellation fee shall be determined having regard to:

  • Technician time allocated;
  • Travel costs incurred;
  • Loss of appointment availability;
  • Administrative costs.

11.4 Cheap Geek reserves the right to waive cancellation fees at its sole discretion.


12. SAFE WORKING ENVIRONMENT

12.1 The Customer must provide a safe and suitable working environment for all Cheap Geek employees, contractors and representatives.

12.2 The Customer warrants that:

(a) Access pathways are safe and unobstructed;

(b) The work area is safe;

(c) Dangerous animals are restrained;

(d) Known hazards are disclosed;

(e) Electrical installations are safe and compliant;

(f) No illegal activity is occurring at the premises.

12.3 The Customer must not engage in:

  • Threatening behaviour;
  • Aggressive behaviour;
  • Harassment;
  • Discrimination;
  • Intimidation;
  • Abusive conduct.

12.4 Cheap Geek reserves the right to immediately terminate services where a technician reasonably believes their safety or wellbeing may be at risk.

12.5 Charges may still apply for attendance and time incurred.


13. ACCESS TO PROPERTY

13.1 The Customer grants Cheap Geek permission to enter the premises where services are to be performed.

13.2 The Customer must ensure:

(a) Reasonable access is available;

(b) Necessary permissions have been obtained;

(c) Utilities required for service provision are available.

13.3 Cheap Geek shall not be responsible for delays caused by restricted access.

13.4 Where attendance is prevented due to access issues, additional charges may apply.


14. ACCESS TO SYSTEMS, ACCOUNTS & DATA

14.1 The Customer authorises Cheap Geek to access:

  • Computers;
  • Servers;
  • Mobile devices;
  • Cloud services;
  • Software platforms;
  • Email systems;
  • Data storage devices;
  • Network infrastructure.

14.2 Cheap Geek may access, view, modify, transfer, copy, configure, remove or otherwise interact with systems and data where reasonably necessary to provide services.

14.3 The Customer acknowledges that access to certain systems may require administrative privileges, passwords or authentication credentials.

14.4 The Customer authorises Cheap Geek to temporarily disable security controls where reasonably necessary to diagnose or resolve faults.


15. CUSTOMER DATA BACKUP OBLIGATIONS

15.1 The Customer is solely responsible for maintaining backups of:

  • Data;
  • Applications;
  • Emails;
  • Databases;
  • System configurations;
  • User profiles;
  • Cloud-stored information.

15.2 Cheap Geek strongly recommends that all data be backed up prior to any service being performed.

15.3 Unless specifically engaged and paid to perform backup services, Cheap Geek does not guarantee the preservation of any data.

15.4 Cheap Geek shall not be liable for:

  • Data loss;
  • Data corruption;
  • Data alteration;
  • Inaccessible files;
  • Failed backups;
  • Failed restorations.

15.5 The Customer acknowledges that certain repair procedures may require:

  • Operating system reinstallation;
  • Device resets;
  • Drive formatting;
  • Data migration.

16. SOFTWARE LICENSING

16.1 The Customer warrants that all software provided for installation, migration, support or configuration is properly licensed.

16.2 Cheap Geek will not knowingly:

  • Install pirated software;
  • Circumvent software licensing;
  • Remove licensing protections;
  • Bypass activation requirements.

16.3 Cheap Geek reserves the right to refuse installation where licensing cannot be reasonably verified.

16.4 The Customer remains solely responsible for:

  • Licensing compliance;
  • Software subscriptions;
  • Product keys;
  • User entitlements.

17. HARDWARE & SOFTWARE INSTALLATIONS

17.1 The Customer authorises Cheap Geek to install hardware and software requested by the Customer.

17.2 Hardware installations may include:

  • Storage devices;
  • Memory upgrades;
  • Processors;
  • Cooling systems;
  • Network devices;
  • Printers;
  • Peripherals.

17.3 Software installations may include:

  • Operating systems;
  • Productivity software;
  • Security software;
  • Drivers;
  • Utilities;
  • Business applications.

17.4 Cheap Geek does not guarantee compatibility between all hardware, software and existing systems.

17.5 Compatibility issues may only become apparent after installation.


18. REMOTE SUPPORT SERVICES

18.1 Cheap Geek may provide services remotely using remote access technologies.

18.2 By requesting remote support, the Customer authorises Cheap Geek to remotely access relevant systems.

18.3 The Customer acknowledges that:

(a) Certain issues cannot be resolved remotely;

(b) Remote support may be limited by internet connectivity;

(c) System performance may affect service delivery;

(d) Some issues may require onsite attendance.

18.4 Cheap Geek shall not be liable for interruptions caused by internet failures, third-party service outages or technical limitations beyond its control.


19. TECHNOLOGY LIMITATIONS

19.1 The Customer acknowledges that technology systems are inherently complex.

19.2 Cheap Geek does not warrant or guarantee that:

(a) Every fault will be identified;

(b) Every issue can be repaired;

(c) Every security threat can be detected;

(d) Every system can be restored.

19.3 Cheap Geek will use reasonable skill and care in providing services but does not guarantee specific outcomes unless expressly agreed in writing.

19.4 Diagnostic fees and labour charges may still apply where a fault cannot ultimately be resolved.


20. REVISED DIAGNOSES & CHANGING RECOMMENDATIONS

20.1 Initial assessments are based upon information available at the time of inspection.

20.2 Additional faults, hidden defects or previously undiscovered issues may become apparent during:

  • Diagnostics;
  • Testing;
  • Disassembly;
  • Repair;
  • Configuration.

20.3 Cheap Geek reserves the right to revise:

  • Quotes;
  • Repair recommendations;
  • Completion timeframes;
  • Proposed solutions.

20.4 The Customer acknowledges that the final recommended solution may differ from any preliminary diagnosis provided.

20.5 Where additional work is required, Cheap Geek will seek approval before proceeding where reasonably practicable.


21. DATA RECOVERY SERVICES

21.1 Data recovery services are performed on a best-efforts basis.

21.2 Cheap Geek does not guarantee that any data can be recovered.

21.3 The Customer acknowledges that:

(a) Storage devices may already be damaged prior to service;

(b) Data may be permanently lost before engagement of Cheap Geek;

(c) Recovery attempts may not be successful;

(d) Additional damage may be discovered during diagnostics.

21.4 No refund shall be payable solely because data recovery was unsuccessful.

21.5 The Customer accepts all risks associated with recovery attempts.

21.6 Cheap Geek shall not be liable for any loss arising from data that cannot be recovered.


22. RECOMMENDATIONS, UPGRADES & REPLACEMENTS

22.1 In the course of providing services, Cheap Geek may recommend:

  • Hardware upgrades;
  • Software upgrades;
  • Device replacement;
  • Network improvements;
  • Security improvements;
  • Data protection solutions.

22.2 The Customer acknowledges that Cheap Geek fulfils its obligations by providing professional recommendations regardless of whether those recommendations are implemented.

22.3 Cheap Geek shall not be liable for any loss resulting from a Customer’s decision not to implement recommended solutions.

22.4 Recommendations provided by Cheap Geek are based on information available at the time and may change as technology evolves.


23. THIRD-PARTY PRODUCTS & SERVICES

23.1 Cheap Geek may recommend or assist with third-party products or services.

23.2 Cheap Geek does not control and is not responsible for:

  • Third-party software;
  • Cloud platforms;
  • Internet providers;
  • Hardware manufacturers;
  • Online services;
  • External service providers.

23.3 Any warranty provided by a manufacturer remains solely the responsibility of that manufacturer.

23.4 Cheap Geek makes no representation regarding the future performance or availability of third-party services.


24. RIGHT TO REFUSE OR TERMINATE SERVICES

24.1 Cheap Geek reserves the right to refuse, suspend or terminate services at any time where:

(a) Illegal activity is suspected;

(b) Fraud is suspected;

(c) The Customer breaches these Terms;

(d) Payment remains outstanding;

(e) The Customer behaves aggressively, abusively or inappropriately;

(f) The work requested may breach any law;

(g) Technician safety may be compromised;

(h) The requested services are outside Cheap Geek’s capabilities.

24.2 Cheap Geek may terminate services without notice where immediate termination is reasonably necessary.

24.3 Charges incurred prior to termination remain payable.


25. PRIVACY & CONFIDENTIALITY

25.1 Cheap Geek will collect, use and store personal information in accordance with:

  • The Privacy Act 1988 (Cth);
  • Australian Privacy Principles;
  • Cheap Geek’s Privacy Policy.

25.2 Information collected may include:

  • Contact details;
  • Device information;
  • Service history;
  • Payment information;
  • Technical information relevant to service delivery.

25.3 Both parties agree to keep confidential any proprietary or confidential information disclosed during the provision of services.

25.4 Confidential information may be disclosed where required by law.


26. INTELLECTUAL PROPERTY

26.1 All intellectual property owned by Cheap Geek remains the property of Cheap Geek.

26.2 Nothing in these Terms transfers ownership of:

  • Software;
  • Documentation;
  • Processes;
  • Systems;
  • Trade marks;
  • Branding;
  • Website content.

26.3 Customers are granted a non-exclusive, non-transferable licence to use materials supplied solely for their intended purpose.

26.4 Customers must not reproduce, distribute or exploit Cheap Geek intellectual property without written permission.


27. MARKETING, REVIEWS & TESTIMONIALS

27.1 Cheap Geek may request customer reviews and feedback.

27.2 Where a Customer voluntarily provides:

  • Reviews;
  • Testimonials;
  • Feedback;
  • Photographs;

the Customer grants Cheap Geek permission to use such material for marketing and promotional purposes.

27.3 Personal information will not be disclosed except as permitted by law.

27.4 Customers may withdraw consent for future use by providing written notice.


28. LIMITATION OF LIABILITY

28.1 Nothing in these Terms excludes rights that cannot be excluded under the Australian Consumer Law.

28.2 To the maximum extent permitted by law, Cheap Geek’s liability shall be limited to:

(a) Re-supplying the services;

(b) Repairing the affected goods;

(c) Replacing the affected goods;

(d) Refunding amounts paid for the relevant services or goods.

28.3 Cheap Geek shall not be liable for losses arising from:

  • Hardware failure;
  • Software failure;
  • Security incidents;
  • Cyber attacks;
  • Virus infections;
  • Third-party actions;
  • Customer negligence.

28.4 Liability is limited to the amount paid by the Customer for the affected service.


29. CONSEQUENTIAL LOSS EXCLUSION

29.1 To the maximum extent permitted by law, Cheap Geek shall not be liable for:

(a) Loss of profits;

(b) Loss of revenue;

(c) Loss of business opportunity;

(d) Loss of goodwill;

(e) Loss of anticipated savings;

(f) Loss of contracts;

(g) Business interruption;

(h) Consequential loss;

(i) Indirect loss.

29.2 This exclusion applies regardless of whether the loss was foreseeable.


30. CUSTOMER INDEMNITY

30.1 The Customer indemnifies Cheap Geek, its directors, employees, contractors and representatives against all claims, losses, liabilities, damages, costs and expenses arising from:

(a) Breach of these Terms;

(b) Unauthorised software;

(c) Infringement of third-party rights;

(d) Misuse of services;

(e) Customer negligence;

(f) False or misleading information supplied by the Customer.

30.2 This indemnity survives termination of these Terms.


31. PAYMENT DISPUTES & CHARGEBACKS

31.1 The Customer agrees not to initiate a payment dispute, chargeback or payment reversal where services have been properly performed or goods properly supplied.

31.2 Where a chargeback or payment reversal is initiated, Cheap Geek reserves the right to recover:

(a) Outstanding service fees;

(b) Merchant processing fees;

(c) Chargeback fees;

(d) Administrative costs;

(e) Debt recovery costs;

(f) Legal costs on a solicitor-client basis.

31.3 The Customer remains liable for all properly incurred charges regardless of any dispute initiated through a financial institution.

31.4 Cheap Geek reserves the right to suspend future services while a payment dispute remains unresolved.


32. STORAGE OF CUSTOMER PROPERTY

32.1 Cheap Geek may store customer equipment where:

(a) Repairs are pending;

(b) Parts are awaiting delivery;

(c) The Customer has not collected completed repairs;

(d) Payment remains outstanding.

32.2 Cheap Geek shall exercise reasonable care while customer equipment remains in its possession.

32.3 Storage is provided at the Customer’s risk.

32.4 Cheap Geek is not responsible for deterioration caused by:

  • Existing faults;
  • Corrosion;
  • Battery degradation;
  • Environmental factors;
  • Manufacturer defects.

33. UNCOLLECTED EQUIPMENT

33.1 Customers must collect equipment promptly following notification that work has been completed.

33.2 Equipment remaining uncollected for more than thirty (30) days may incur storage fees.

33.3 Storage fees may be charged at:

$5.00 per day per item

or such other amount as notified by Cheap Geek from time to time.

33.4 Where equipment remains uncollected for ninety (90) days after completion of services, Cheap Geek may, after making reasonable attempts to contact the Customer:

(a) Sell the equipment;

(b) Recycle the equipment;

(c) Dispose of the equipment;

(d) Retain proceeds to recover outstanding amounts.

33.5 Any surplus proceeds shall be handled in accordance with applicable law.


34. SUSPENSION OF SERVICES

34.1 Cheap Geek may suspend services immediately where:

(a) Payment remains overdue;

(b) Fraudulent activity is suspected;

(c) The Customer breaches these Terms;

(d) Continued services may create a legal, financial or security risk.

34.2 Suspension does not relieve the Customer of payment obligations.

34.3 Cheap Geek shall not be liable for losses resulting from suspension undertaken under this clause.


35. TERMINATION

35.1 Either party may terminate services by providing written notice.

35.2 Cheap Geek may immediately terminate services where:

(a) The Customer materially breaches these Terms;

(b) Payment remains outstanding;

(c) Illegal activity is suspected;

(d) The Customer behaves in an abusive, threatening or inappropriate manner.

35.3 Termination shall not affect rights or obligations accrued prior to termination.

35.4 Any unpaid amounts become immediately due and payable upon termination.


36. FORCE MAJEURE

36.1 Cheap Geek shall not be liable for any delay or failure to perform obligations arising from events beyond its reasonable control.

36.2 Such events include but are not limited to:

  • Natural disasters;
  • Floods;
  • Fires;
  • Storms;
  • Earthquakes;
  • Pandemics;
  • Epidemics;
  • Government restrictions;
  • Industrial disputes;
  • Internet outages;
  • Cyber attacks;
  • Utility failures;
  • Supplier shortages;
  • Acts of terrorism;
  • Civil unrest.

36.3 Obligations affected by a Force Majeure event shall be suspended for the duration of the event.


37. NON-SOLICITATION OF STAFF & CONTRACTORS

37.1 The Customer agrees not to directly or indirectly solicit, employ, engage or contract any Cheap Geek employee, contractor or subcontractor for technology-related services without the prior written consent of Cheap Geek.

37.2 This restriction applies during the provision of services and for a period of twelve (12) months following completion of the last service provided to the Customer.

37.3 This clause applies regardless of whether services are performed onsite, remotely or through a third party.


38. ENTIRE AGREEMENT

38.1 These Terms and Conditions, together with any:

  • Quotations;
  • Service Agreements;
  • Invoices;
  • Privacy Policy;
  • Warranty Policy;

constitute the entire agreement between the parties.

38.2 No verbal statement or representation shall form part of the agreement unless confirmed in writing.


39. SEVERABILITY

39.1 If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision shall be severed.

39.2 The remaining provisions shall continue in full force and effect.

39.3 The parties agree that any invalid provision shall be replaced with a valid provision reflecting the original intent as closely as possible.


40. AMENDMENTS, GOVERNING LAW & JURISDICTION

40.1 Cheap Geek reserves the right to amend these Terms and Conditions from time to time.

40.2 Updated Terms will be published on the Cheap Geek website.

40.3 Continued use of Cheap Geek services constitutes acceptance of the updated Terms.

40.4 These Terms are governed by the laws of Queensland, Australia.

40.5 The parties submit to the exclusive jurisdiction of the Courts of Queensland and any courts entitled to hear appeals from those courts.

40.6 If any dispute arises, the parties agree to first attempt to resolve the dispute through good-faith negotiation before commencing legal proceedings.

SCHEDULE A – CYBER SECURITY DISCLAIMER

41. Cyber Security Risks

41.1 The Customer acknowledges that no computer system, network, cloud service, software application or security solution can be guaranteed to be completely secure.

41.2 Cheap Geek does not warrant that:

(a) Systems will be immune from cyber attacks;

(b) Security breaches will never occur;

(c) Malware will never be introduced;

(d) Data theft will never occur;

(e) Unauthorised access will never occur.

41.3 Security recommendations provided by Cheap Geek are intended to reduce risk only and do not eliminate risk.

41.4 The Customer remains responsible for maintaining appropriate cybersecurity measures including:

  • Password management;
  • Multi-factor authentication;
  • User training;
  • Security policies;
  • Cyber insurance;
  • Backup systems.

41.5 Cheap Geek shall not be liable for losses arising from:

  • Cyber attacks;
  • Ransomware;
  • Phishing attacks;
  • Social engineering;
  • Malware infections;
  • Third-party breaches.

SCHEDULE B – MANAGED SERVICES TERMS

42. Managed Services

42.1 Managed Services may include:

  • Monitoring;
  • Maintenance;
  • Remote support;
  • Security management;
  • Backup monitoring;
  • Patch management;
  • Vendor liaison.

42.2 Managed Services are provided on a reasonable efforts basis.

42.3 Cheap Geek does not guarantee:

  • Continuous system availability;
  • Uninterrupted internet access;
  • Zero downtime;
  • Prevention of all failures.

42.4 Scheduled maintenance may occasionally require temporary interruption of services.

42.5 Emergency work outside agreed support arrangements may incur additional charges.

42.6 The Customer must maintain valid software licensing and hardware support arrangements.


SCHEDULE C – REMOTE ACCESS CONSENT

43. Remote Access Services

43.1 By requesting remote support, the Customer expressly authorises Cheap Geek to remotely access devices and systems.

43.2 Remote sessions may involve:

  • Viewing screens;
  • Controlling devices;
  • Installing software;
  • Removing software;
  • Modifying settings;
  • Restarting devices.

43.3 The Customer acknowledges that remote support may expose personal or confidential information visible on the device during the session.

43.4 Cheap Geek will use reasonable care when accessing systems remotely.

43.5 The Customer may terminate a remote session at any time, however service fees remain payable for time incurred.


SCHEDULE D – BUSINESS CUSTOMER TERMS

44. Business Customers

44.1 Business customers remain responsible for:

  • Internal policies;
  • Regulatory compliance;
  • Record keeping;
  • Data retention obligations;
  • Employee conduct.

44.2 Cheap Geek is not responsible for ensuring compliance with:

  • Privacy legislation;
  • Industry regulations;
  • Licensing requirements;
  • Employment laws.

44.3 Recommendations provided by Cheap Geek should not be interpreted as legal, accounting, compliance or regulatory advice.

45. Cloud Services

45.1 Cheap Geek may assist with:

  • Microsoft 365;
  • Google Workspace;
  • Dropbox;
  • OneDrive;
  • SharePoint;
  • Third-party cloud services.

45.2 Cheap Geek does not own or control these services.

45.3 Cheap Geek shall not be liable for:

  • Cloud outages;
  • Service interruptions;
  • Data loss caused by cloud providers;
  • Third-party account suspensions;
  • Provider policy changes.

45.4 The Customer remains responsible for maintaining access credentials and account ownership.

45.5 Cloud backups should not be assumed unless specifically implemented and verified.


SCHEDULE F – MICROSOFT 365 & GOOGLE WORKSPACE DISCLAIMER

46. Productivity Platforms

46.1 Cheap Geek may assist with configuration, migration and support of Microsoft 365 and Google Workspace environments.

46.2 Cheap Geek does not control:

  • Microsoft services;
  • Google services;
  • Licensing models;
  • Service availability.

46.3 The Customer acknowledges that:

(a) Service interruptions may occur;

(b) Licensing requirements may change;

(c) Features may be modified by the provider;

(d) Pricing may change without notice.

46.4 Cheap Geek shall not be liable for losses caused by provider outages or provider decisions.


SCHEDULE G – WEBSITE ACCEPTABLE USE POLICY

47. Website Usage

47.1 Users must not:

(a) Attempt unauthorised access to systems;

(b) Upload malicious software;

(c) Interfere with website operations;

(d) Use automated tools to scrape website content;

(e) Impersonate another person or organisation.

47.2 Cheap Geek reserves the right to restrict access to any user who breaches this policy.

47.3 All website content remains the intellectual property of Cheap Geek unless otherwise stated.

47.4 Website information is provided for general information purposes only and may be amended without notice.


SCHEDULE H – EMAIL, SMS & COMMUNICATIONS CONSENT

48. Electronic Communications

48.1 By engaging Cheap Geek, the Customer consents to receiving communications via:

  • Email;
  • SMS;
  • Telephone;
  • Online portals;
  • Automated notification systems.

48.2 Communications may include:

  • Appointment confirmations;
  • Repair updates;
  • Invoice notifications;
  • Security alerts;
  • Service reminders;
  • Warranty notifications;
  • Marketing communications (subject to applicable laws).

48.3 Customers may opt out of marketing communications at any time.

48.4 Operational communications relating to existing services may continue to be sent where reasonably necessary.


SCHEDULE I – ARTIFICIAL INTELLIGENCE & AUTOMATION SERVICES

49. AI Services

49.1 Where Cheap Geek provides AI-related services, automation services or AI-generated outputs, such outputs are provided as assistance tools only.

49.2 Cheap Geek does not warrant:

  • Accuracy;
  • Completeness;
  • Suitability for any purpose.

49.3 Customers should independently verify any information generated by AI systems before relying upon it.

49.4 Cheap Geek shall not be liable for losses resulting from reliance on AI-generated outputs.


SCHEDULE J – SURVIVAL OF TERMS

50. Survival

50.1 The following clauses survive termination of services:

  • Payment obligations;
  • Confidentiality obligations;
  • Intellectual property rights;
  • Indemnities;
  • Limitation of liability provisions;
  • Chargeback provisions;
  • Governing law provisions.

50.2 Termination of services does not affect accrued rights or obligations existing prior to termination.
